Section 31 – Powers of Committee – Juvenile Justice (Care And Protection Of Children)

(1) The Committee shall have the final authority to dispose of cases for the care, protection, treatment, development and rehabilitation of the children as well as to provide for their basic needs and protection of human rights.

(2) Where a Committee has been constituted for any area, such Committee shall, notwithstanding anything contained in any other law for the time being in force, but save as otherwise expressly provided in this Act, have the power to deal exclusively with all proceedings under this Act relating to children in need of care and protection.

Comment:

Section 31 relates to the powers of the Child Welfare Committee. The Committee has been conferred power as a final authority to dispose of cases relating to (1) care, (2) protection, (3) treatment, (4) development, and (5) rehabilitation of children in need. It is also entrusted the power to provide for basic needs of children who need care and protection and ensure that child’s human rights are protected.

The Committee shall take all measures as provided in the Act for the care and protection of needy children.
